ACCEPTANCE OF TERMS

By using the FollowFormation.com web site ('FoFo'), a service of Aer Marketing Inc. ('Aer'), you are agreeing to be bound by the following terms and conditions ('Terms of Use'), which may be updated by us from time to time without notice to you. By accessing and using FoFo, you accept and agree to be bound by the terms and provision of the Terms of Use. In addition, when using particular Aer owned or operated services, you and Aer shall be subject to any posted guidelines or rules applicable to such services, which may be posted and modified from time to time. All such guidelines or rules are hereby incorporated by reference into the Terms of Use. Aer may also offer other services that are governed by different Terms of Use.

DESCRIPTION OF SERVICES

Subject to full compliance with the Terms of Use, FoFo may offer to provide certain services and content, as described more fully on the Site, ("Services"). Services shall include, but not be limited to, any service and content FoFo performs for you, as well as the offering of any materials displayed, transmitted or performed on the Site or through the Services (including, but not limited to text, messages, information, data, graphics, photographs, images, illustrations, software, links, audio clips and video clips, also known as the "Content"). FoFo may change, suspend or discontinue the Services including any Content for any reason, at any time, including the availability of any feature or content.

BASIC TERMS

1. You must be 13 years or older to use this site.
2. You are responsible for any activity that occurs under your screen name.
3. You are responsible for keeping your password secure.
4. You may not use the FoFo service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
5. You are solely responsible for your conduct and any data, text, information, screen names, links ("Content") that you submit, post, and display on the FoFo service.
6. You must not modify, adapt or hack FoFo or modify another website so as to falsely imply that it is associated with FoFo .
7. You agree not to reproduce, duplicate, copy, sell, resell or explot any portion of the Service, use of the Service, or access to the Service without the express written permission by Aer.
8. You must not transmit any worms or viruses or any code of a destructive nature.
9. You must not, in the use of FoFo, violate any laws in your jurisdiction (including but not limited to copyright laws).
10. You must be a human. Accounts controlled by 'bots' or automated methods to use FoFo services are not permitted.

While FoFo prohibits such conduct and content on its site, you understand and agree that FoFo cannot be responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the FoFo service at your own risk.

GENERAL CONDITIONS

1. Your use of the Service is at your sole risk.
2. Technical support is only provided to paying account holders and is only available via email.
3. You understand that Aer uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage and related technology required to run the Service.
4. You understand that the technical processing and transmission of the Service, including your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
5. We reserve the right, in accordance with any applicable laws, to refuse service to anyone for any reason at any time.
6. We may, but have no obligation to, remove Content and accounts containing, including, without limitation, Content and accounts that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
7. Pages on other websites which display data hosted on FoFo must provide a link back to FoFo.
8. You will indemnify and hold harmless FoFo, its parents, subsidiaries, affiliates, customers, vendors, officers and employees from any liability, damage or cost (including reasonable attorneys fees and cost) from (i) any claim or demand made by any third party due to or arising out of your access to the Site, use of the Services, violation of the Terms of Use by you, or the infringement by you, or any third party using your account, of any intellectual property or other right of any person or entity.
9. You acknowledge that FoFo has no control over, and no duty to take any action regarding: which users gain access to the Site or use the Services; what effects the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of having been exposed to the Content. You release FoFo from all liability for you having acquired or not acquired Content through the Site or the Services. The Site or Services may contain, or direct you to sites containing, information that some people may find offensive or inappropriate. FoFo makes no representations concerning any content contained in or accessed through the Site or Services, and FoFo will not be responsible or liable for the accuracy, copyright compliance, legality or decency of material contained in or accessed through the Site or the Services.
10. The Service, Content and Site are provided on an 'as is' basis, without warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose or non-infringement.
11. FoFo may terminate or suspend any and all Services and your FoFo account immediately, without prior notice or liability, if you breach any of the terms or conditions of the Terms of Use. Upon termination of your account, your right to use the Services will immediately cease. If you wish to terminate your FoFo account, you may simply discontinue using the Services. All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
12. The failure of Aer to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. The Terms of Use constitutes the entire agreement between you and Aer and govern your use of the Service, superceding any prior agreements between you and Aer.
